These terms and conditions govern all products bought on or after 01 June, 2026. Purchases made before this date are subject to Breathalysers Australia’s earlier terms and conditions.

By continuing to use the Breathalysers Australia website, you acknowledge that you have read and agree to these Terms and Conditions. If you do not accept them, please discontinue use of the site.

 

Definitions
For the purposes of these Terms and Conditions, the terms “we,” “us,” and “our” refer to Breathalysers Australia (ABN 21 611 688 898), based in Randwick, NSW 2031, Australia.
The term “you” refers to the individual using the website and purchasing from Breathalysers Australia.
“The website” refers to the Breathalysers Australia site available at https://breathalysers-australia.com.au/.
These Terms and Conditions, together with your purchase order, constitute a binding agreement between you and Breathalysers Australia. This agreement cannot be modified unless any changes are approved in writing by Breathalysers Australia.

 

Security
At Breathalysers Australia we take your privacy seriously which is why we make every effort to ensure your shopping experience with us is safe and secure.
We do not sell or disclose your details to any other third parties and protect your personal and order details by using a secure SSL environment.
We do not retain any credit card information details after purchase.

 

Information Collection
Breathalysers Australia collects information from our customers so that we can provide you with the best possible customer service. Certain information is necessary so that we can successfully provide you with the service and/or product that you require. This personal information is stored in our order processing system and is not available to unauthorised parties. Information we require can include the full name of the customer and recipient, email address, company name (if applicable), invoice address, delivery address, and contact phone number.
Any information collected is treated with the utmost privacy and is only used so that we can better serve you as a customer in the delivery and completion of your order.

 

Legal Age Confirmation
By submitting an order, accepting the Terms and Conditions, and entering into an agreement with us, you affirm that you are at least 18 years old. Individuals under 18 are not permitted to place orders. If Breathalysers Australia incurs any loss, financial or otherwise, because an underage person places an order, the company reserves the right to seek compensation from that individual’s parent(s) or legal guardian(s) for engaging in the transaction.

 

Serves Australia and New Zealand Orders Only
We provide products exclusively within the Commonwealth of Australia. Breathalysers Australia does not sell or deliver items to destinations outside Australia and New Zealand.

 

Orders
By submitting an order through the Breathalysers Australia website, you acknowledge that you have read and accepted these Terms and Conditions and have completed the required checkout order form.
Your order is finalised when you click the “Place order” button on the form. By doing so, you agree to the Terms and Conditions and indicate your intent to purchase the selected items. Once your order has been successfully processed, you will receive an order number for reference.
All product listings and information on the Breathalysers Australia website are provided as an invitation to treat and do not constitute a binding offer to sell. However, once an order is placed, Breathalysers Australia will make reasonable efforts to supply the requested items.
After placing your order, you will receive an Order Confirmation email acknowledging that your order is being processed. A legally binding agreement is only formed once your order has been internally reviewed and verified, including checks for potential credit card or identity fraud. We reserve the right to decline or cancel orders, terminate accounts, or remove any website content, including product listings, at our discretion.
You will be notified by email once your order has been dispatched. If, after payment has been received, your order cannot be completed or shipped, we will contact you via email or phone.

 

Identity Fraud Statement
Breathalysers Australia uses advanced security technology to safeguard the sensitive information you provide on our website, including payment and credit card details as well as personal data. Personal and financial information is securely encoded before being transmitted over the internet, helping prevent unauthorised access during transfer to our servers.
Although we implement strict security measures, Breathalysers Australia cannot accept liability for any direct or indirect loss or damage resulting from fraudulent use of credit card information on the site.

Fraud Prevention Protocols
For purchases totalling $2,000 or more, Breathalysers Australia may require customers to confirm their identity and/or payment details before the order is shipped.
This verification process may involve submitting one or more of the following:
·        a government-issued ID (name only required), and/or
·        confirmation of the credit or debit card used for the transaction
In certain cases, we may also request verification for lower-value orders if our systems detect indicators of potential fraud.
If the required verification is not completed within a reasonable period, we reserve the right to:
·        postpone shipment of the order, or
·        cancel the order and refund the original payment method
Any information provided during this process will be kept secure and managed in line with our Privacy Policy.

 

Payment Methods
We currently accept payments via Visa, MasterCard, PayPal, Afterpay, Apple Pay, Google Pay, and Bank Transfer (via email).
Payments are only processed once your purchase order has been fully verified. Orders submitted on weekends (Saturday and Sunday) or on public holidays will be handled on the next business day. Our business days run from Monday to Friday, excluding public holidays.
Credit Cards: We cannot process credit cards issued by non-Australian banks or financial institutions. Please be aware that using debit or cheque cards may slow down order processing due to possible spending limits. After placing a credit card order, you will receive an order confirmation along with a tax invoice via email, which serves as your proof of purchase.
PayPal: For PayPal transactions, an order confirmation and tax invoice will be sent to your email. The tax invoice will act as your proof of purchase.
All Orders: To ensure security and help prevent credit card and identity fraud, Breathalysers Australia may request additional identification or relevant information before processing your order.

 

Shipping/Delivery
We pride ourselves on our level of service and have fast turnaround delivery times. All orders placed before 11am are dispatched the same day and leave on an Australia Post Parcel Post service of a planned 2 working days for East Coast metropolitan Australia. Please allow up to an additional 2–3 days for Regional Australia, NT, WA or TAS locations.
We use Australia Post and dispatch from NSW daily.
Once dispatched, we allow up to 60 days for the customer to let us know if the order is not received. After 60 days, we have a no-liability clause as it becomes very difficult to find out where the parcel is located.
All deliveries are handled by one driver and will be brought to the ground floor of your residence. For large or oversized items, you must be available to assist with unloading. If assistance is not provided and a second delivery attempt or a two-person delivery is required, additional fees will apply at your expense. If the item is returned due to lack of assistance at the time of delivery, you will receive a refund for the item cost only, minus any return shipping charges.
Deliveries via Australia Post will be sent to the shipping address provided in your order. If no one is present at the delivery location to receive the package, a card will be left with instructions on how to arrange redelivery or collection. While every effort is made to deliver within the estimated timeframe, delivery dates cannot be guaranteed. Once the item has been delivered, ownership and responsibility for any loss or damage transfer to you as the customer.
How much will shipping cost?
We have 3 x shipping options:
·        Parcel Post (uninsured) $10.97
·        Parcel Post (insured) $12.97
·        Express Post additional $6.00
When will my items be shipped?
All orders submitted prior to 11am AEST will be shipped on the same day. Australia Post Standard Service aims for a delivery timeframe of 2 working days for metropolitan areas on the East Coast of Australia. For regional locations, as well as those in NT, WA, or TAS, please allow an extra 2–3 working days for delivery. Should you need your parcel more urgently (within 1 to 3 days across the nation), we recommend selecting our Australia Post Express option during checkout.
Can I ship to a PO Box?
Yes, you can. We use Australia Post.
Where is my order?
At 5:30 PM on the day of shipment, you will receive an invoice along with tracking details sent to your email. Additionally, you may log into your account on this website to view the tracking and invoice information.

It may take as long as 24 hours for a parcel to appear on: https://auspost.com.au/mypost/track/search
Australia Post missing parcels
Occasionally, parcels may go missing. Should this happen, please reach out to us via our Contact Us webpage.

 

Refunds and Warranty
All of our products have either a 12- or 36-month warranty. If for any reason a product is deemed faulty by Breathalysers Australia, it is the customer’s choice whether they would like a replacement or a refund. Our aim is to ensure you are happy with your product and that it will meet and exceed your expectations. Where a refund is deemed appropriate, it will be issued without delay.
Please note that Breathalysers Australia may require the customer to answer questions regarding the device issue. This includes asking for videos to show the problem. Kindly provide us with the necessary information so we can assess the issue.
Breathalysers Australia is not aware or responsible for how devices are used and stored once outside of our control. Blowing strong concentrations of alcohol across the sensor, leaving batteries in the device whilst in storage, exposure to moisture, excessive heat, or dust particles, and shock from impact can all shorten the lifespan of a breathalyser. These items are not covered under the manufacturer’s warranty.
Purchase warranties are not extended after 12 months for units that are not serviced and recalibrated within this timeframe.
Warranty claims can be made by logging in to your account.

 

Returns & Exchanges
Can I return my product?
We want you to rely on and trust in the products you buy from Breathalysers Australia. If you change your mind, you may return the product to us within 30 days of the date you receive it, and we will issue you with a store credit. The item must not have been opened, used or tampered with in any way, and must be in its original packaging. Note: change of mind returns are different to returning a product under the Australian Consumer Law or CGA if the product is faulty – see the section below entitled Your rights under the Australian Consumer Law or NZ Consumer Guarantees Act.
You will be responsible for the shipping and handling costs for a change of mind return (including any taxes or duties), irrespective of any free, discounted or any other type of shipping promotion that may have been applicable at the time of your order. This includes any costs incurred by shipping the product to you in the first place and the cost of shipping the product back to us.

Store credit voucher codes will be valid for one (1) year from the date of issue.
Our team members will assess the item to determine whether a refund will be offered in accordance with our Returns Policy.
Customers are responsible for the costs of returning the product. If the device is found to be faulty, we will refund the cost of delivery, so please keep your postage receipt. Please use tracked Standard Postage.
If we find the product is working as intended, we will send a video verifying the operation of the unit. In this instance, the customer is liable to pay a $20.00 return postage and packaging fee.

Proof of Purchase
Original cash register receipt or tax invoice (electronic or photograph will be accepted).
Online Tax Invoice (order confirmations will not be accepted).
Please note that our team members are not responsible for proving your purchase. You must supply the proof of purchase, which our team members can validate. If you have proof of purchase and the return meets our policy, we will be able to process a refund on the spot.

 

Consumer Guarantees
Where an item is damaged through misuse, neglect or abnormal use, Breathalysers Australia will not provide a refund or exchange.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
Our policy including the change of mind limits does not exclude or replace your rights under Consumer Guarantees of the Australian Consumer Law, regulations or otherwise as required by law.

 

Wrong Product Delivered
Very occasionally we may accidentally ship the wrong product to you. If you have received an incorrect product, let us know as soon as you can, ideally within 3 days of receiving your delivery. We will offer to send you the correct product and arrange for the pick-up and return of the incorrectly shipped product at no cost to you.

 

Faults and Damages
If a product arrives and the packaging or the product itself is clearly and significantly damaged, you should take photos or a video showing the damage and contact us immediately.
The Australian Consumer Law (ACL) and NZ Consumer Guarantees Act 1993 (CGA) are the laws for fair trading and consumer protection in Australia and New Zealand, respectively. You have rights as a consumer under the ACL or CGA in relation to our goods that we cannot exclude. This includes consumer guarantees that our goods will:
·        be of acceptable quality and not be faulty or unsafe;
·        match their description; and
·        be fit for their intended purpose.
Nothing in these Terms is intended to limit or exclude your rights as a consumer under the ACL or CGA.
You are entitled to a replacement or refund for a major failure.

 

Cancellations
You may cancel all or part of an order before it reaches the dispatch processing stage, in which case you can choose whether to receive a store credit voucher or refund in the amount you paid for the products (including shipping, assuming there are no other products remaining on the order to be shipped). After an order reaches the dispatch processing stage, cancellations or changes are only possible if we agree to them. As we aim to process your order as soon as possible, which could be within hours of you placing your order, requests for cancellations should be lodged as soon as possible after ordering. Once products have been shipped, you cannot cancel them.

 

Exchange
Unfortunately, we do not offer exchanges of our products. Simply return your items in accordance with our Returns Policy and place a new order.

 

Our Rights
We reserve the right to refuse a return in cases where we cannot be reasonably satisfied that you purchased the product from us or where we are not responsible for the damage in accordance with our Faults and Damages Policy.

 

Other Policies
We reserve the right not to do business with a customer at any stage. We may block access to our website and/or office contacts and take other steps we believe reasonably necessary if a customer engages in conduct that we objectively consider to be unprofessional, inappropriate, bullying or abusive.

 

Force Majeure
We shall not be responsible for any delay, suspension or failure arising out of any circumstances outside of our reasonable control, including but not limited to acts of God, governmental actions or restrictions, shipping, postal or other relevant transport strike, postal theft, failure or accident, lockouts or other labour difficulty, war or national emergency, epidemics, pandemics, quarantine requirements, acts of terrorism, fire, explosion, flood, an act or omission of a third party (including our delivery partners), inability to obtain any necessary materials, equipment, facilities or services, the failure of performance provided by others, interruption of the internet or a website or social media platform (such as Facebook), or viruses, accidents or breakdown of plant, machinery, software, hardware or communication network.

 

Breathalysers Australia Guarantee
Nothing in these Terms is intended to avoid the provisions of the current Australian Consumer Guarantees Act (“CGA”) except to the extent permitted by the CGA or to exclude liability arising under any other statute. If and to the extent that such liability cannot be lawfully excluded, these Terms shall be modified to the extent necessary to give effect to the above intention. If you are acquiring goods or services from us for the purposes of a business, you agree that the guarantees provided in the CGA will not apply. Breathalysers Australia does not provide any express guarantees (as that term is defined in the CGA) other than those expressly confirmed in these Terms.

 

Currency and GST
All prices contained within this website are quoted in Australian dollars. Prices are GST-inclusive unless otherwise stipulated.
Prices May Be Updated Without Prior Notice
Breathalysers Australia strives to ensure that all prices displayed on its website are accurate and up to date. However, prices may change without prior notice. Breathalysers Australia also reserves the right to modify any listed prices on the website at any time without advance notification.

 

Clerical Errors
Breathalysers Australia strives to ensure that all product details, pricing, and related information are accurate and up to date. However, occasional typographical errors may occur. We do not accept liability for any such errors and reserve the right to decline or cancel orders resulting from misunderstandings caused by these inaccuracies.

 

Computer Hardware
Breathalysers Australia accepts no liability for any loss of or damage to data, applications, software, or any other information stored on electronic or computing products sold through the website. Any recovery of such data is not included under Breathalysers Australia’s warranty coverage.
If an electronic or computing device is returned for a refund or replacement, Breathalysers Australia will not be responsible for any data that remains on the device at the time it is returned. It is the customer’s responsibility to ensure that all necessary backups of data and other stored information are completed before sending any such products back.
Breathalysers Australia also disclaims any responsibility for any direct, indirect, incidental, or consequential losses arising from the purchase of electronic or computing products. This includes, but is not limited to, loss of profits, business interruption or service interruptions, diminished customer trust or missed business opportunities, equipment damage, and related expenses associated with data recovery or system restoration, re-creation of lost data or software, or loss of confidentiality.
No guarantee is provided that repairing, replacing, or refunding any electronic or computing product will be free from risk to the integrity of any stored data, programs, or digital content.

 

Validity and Enforceability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to be valid and in full effect.
A failure by either party to enforce any part of these Terms and Conditions does not waive or limit the right to enforce them later, and does not affect their ongoing validity.

 

No Transfer of Rights Allowed
You may not transfer, whether directly or indirectly, all or any part of your rights or obligations under these Terms and Conditions to any other individual or entity without obtaining prior written approval from Breathalysers Australia. Any attempted transfer made without such consent will be invalid and have no legal effect.

 

Statement of Liability
Breathalysers Australia disclaims responsibility for any indirect or consequential losses that may result from the use of products purchased through its website. This includes, but is not limited to, loss of income or profits, loss of contracts, data loss, loss of goodwill, loss of potential business opportunities, as well as any damage to personal property or personal injury, whether direct or indirect.
This limitation does not apply in the following circumstances:
a. Where the loss was a reasonably foreseeable consequence of Breathalysers Australia failing to comply with a consumer guarantee; or
b. Where Breathalysers Australia is the manufacturer or importer of the product and the loss arises from a safety defect as defined under section 9 of the Australian Consumer Law, provided that no applicable defence under section 142 of that law applies to the product in question.

 

Terms and Conditions Updates
Breathalysers Australia may update or modify these Terms and Conditions at its discretion at any time. The version of the Terms and Conditions in effect when your order is placed will apply to the agreement between you and us.
No third party, including any employee or representative of Breathalysers Australia, is authorised to change or vary these Terms and Conditions for any specific transaction or sale.

 

Applicable Law
These Terms and Conditions are governed by the laws of New South Wales and fall under the jurisdiction of the courts of New South Wales.
